The new work on restructuring law brings together the relevant regulations of StaRUG (Stabilization and Restructuring Framework for Companies) and InsO (Insolvency Code). In addition, it explains restructuring instruments and includes corporate, tax and financing law issues - taking into account the newly formulated IDW standard. This hand-written commentary places particular emphasis on the topics of restructuring plans, planned restructuring and restructuring moderation. It shows which instruments are best suited in which situations. Our partner Jessica Hirsch and Dr. Darko Jordanovski, among others, provide a high level of practical relevance with their contribution to the protective shield procedure (IDW S 9). They examine the topic with a focus on the order and order execution, the assessment of impending insolvency and the qualitative assessment and rough quantification of restructuring measures.
